Man to be hanged for stabbing another person to death

Hamza Mohammed, a guy who fatally stabbed another man at a wild party in Niger State, has been condemned to hung execution.

It was reported that Mohammed and a certain Baba Usman, who is currently at large, pursued the deceased Isah Mohammed until they caught up with him, at which point they repeatedly stabbed him until he passed away.

Isah Mohammed was fatally stabbed by a youth from Barikin Saleh after a free-for-all between adolescents from the Kpakungu neighborhood of Minna and youths from Kpakungu broke out during a party in 2015.

In August 2015, Mohammed was first charged with two counts of joint act and culpable homicide, which are crimes covered by sections 79 and 221 of the penal code, by members of the Niger State Police Command’s Homicide division.

The convict, however, denied participating in the killing, arguing, “I and Baba Usman had pursued the deceased, but Baba Usman was the person that stabbed him before I came there only to meet the deceased in a pool of his own blood.”

Nevertheless, Mohammed acknowledged that both he and Baba Usman followed the dead with the knife in an effort to stab him, claiming that Baba Usman had already done so before he arrived at the scene of the deceased’s death.

“The two-count charge of joint act and culpable homicide punishable under section 221 and section 79 of the penal code was established against the convict Hamza Mohammed and is hereby sentenced and convicted accordingly,” wrote Justice Halima Abdulmalik, Chief Judge of Niger State and Presiding High Court, in a two-hour ruling on Friday.

The judge additionally declared that Mohammed faced the death penalty under sections 79 and 221 for the two counts of joint act and culpable homicide, which the prosecution had successfully shown beyond a reasonable doubt.

She ruled, “The case of culpable homicide punishable by death is mandatory. You Hamza Mohammed is hereby convicted and sentenced to death by hanging until you are dead. May the Lord have mercy on your soul.”
