Ayodeji Alomoge a  28-year-old man, has been sentenced to death by hanging by the Ado Ekiti Division of the Ekiti State High Court for the murder of a man who was having an affair with his wife.

According to the charge against Alomoge, who was tried on a count of charges that implied murder, he had “murdered one Ogunleye Ayomide on June 21, 2022 at Ikere Ekiti, contrary to Section 234 of the Criminal Law of Ekiti State, 2021.”

In his statement to the police, the deceased’s father, Ige Ogunleye, said that he received a call stating that his son had been “beaten to pulp by Alomoge and his gang.” He raced to the scene and saw his son in a pool of his own blood, with varying degrees of injuries to his mouth and head.

I also saw Alomoge being restrained by a few individuals. When I questioned him about why he had done this, he told me that Ayomide had been having extramarital affairs with my wife and that he had threatened to kill him if he continued.

“I brought him (Ayomide) to a nearby hospital and then the University Teaching Hospital in Ilorin, Kwara State, where he subsequently passed away.”

Kunle-Shina Adeyemo, the prosecution, called five witnesses and presented exhibits including the defendant’s comments, photos of the deceased, and a medical report detailing the cause of death.

Adeyinka Opaleke, the defendant’s attorney, testified on his behalf and implored the judge to balance justice and mercy. He did not call any witnesses.

“It would appear to me that rivalry between men over the affection of a woman should not be a ground to justify provocation, unless the situation is such that it is sudden and leading to a heating of passion,” Justice Jubril Aladejana stated in the court ruling on Thursday.

“I thus find the accused person guilty of the murder charge against him and, as a result, convicted as charged.”

“Ayodeji Alomoge shall be hanged by his neck until he is dead,” the court declared.
